Police are trained to fire… they don’t fire indiscriminately in the air, says court Chandigarh news

In a slap in the face of the Mohali District Police, the district court acquitted three people who attacked the police team and shot at the police in 2019. . The court also highlighted the gaps in the prosecution’s story.

The bench of Additional District and Sessions Judge Dr Ajit Atri acquitted Sukhdeep Kumar Sharma, Gurpreet Singh and Raman Kumar on 5th November.

Acquitting the trio, the court said, β€œIn view of the above discussion, it is held that the prosecution has failed to prove the offense under Sections 307 (attempt to murder), 353 (assault or use of criminal force on any person). public servant in the discharge of his duties), 186 (voluntarily obstructing any public servant in the discharge of his public duties) and 34 (acts done by several persons in furtherance of common intention) IPC and section 25 of the Arms Act for which the accused were charged, beyond reasonable doubt And the accused Sukhdeep Kumar Deep, Raman Kumar and Gurpreet Singh have been acquitted of the charges against them. benefit of the doubt.”

Highlighting gaps in the prosecution’s story, the court pointed out that scientific evidence would be relevant in the case as there were allegations of firing against accused Sukhdeep Kumar and Gurpreet Singh. If they had fired, there would have been traces of gunpowder on the hands but no evidence was collected to prove it and no GSR test (gunshot residue) was done. The complainant, who is also an Investigating Officer (IO), is not a novice officer. Instead he is in charge of the CIA and can be made aware of these evidences to be collected during the course of the investigation. In the course of argument the prosecution witness (PW4) (Inspector Satwant Singh) stated that no gun powder was proved in the hands of the accused. It is also mentioned in the reference that although a fingerprint was taken from the gun during the interrogation, it was not sent to any laboratory for analysis.

“If finger prints are not sent to a laboratory for analysis, taking them, if at all, serves no purpose,” the court emphasized.

Suspecting the incident of shooting at the police party, the court stated that according to the case of the prosecution, the accused had fired three shots at the policemen in private and government vehicles. But neither any member of the police force nor any vehicle was shot, nor is there any evidence that any shot was fired at the wall, house or ground.

It is not the subject of the accusation that the accused fired in the air. If the accused did not shoot in the air, but there is no such evidence, nor is there any picture of the accused shooting. The circumstances in the file have increased the suspicion of the prosecution,’ the court pointed out.

It is the case of the prosecution that the members of the police team used nine mm pistols and INSAS rifles, but the court said that the shots fired by the accused did not go anywhere. Even when the police opened fire, no one was hit. It does not mean that the place where the incident took place is an open space. Instead, it is said that there is a house next to the alleged house, where the accused took refuge and shot. But what is surprising is that the police team also fired 12 rounds and INSAS rifles, but no bullets hit the ground, the wall, or the accused.

‘The case that the police fired in the air in defense and the prosecution fired in the air for the defense is unbelievable, 12 rounds were fired in the air and 12 rounds were not fired in the air. MM Pistol and Insas Rifle. Police are trained to shoot and they don’t shoot indiscriminately in the air where three shots were fired from the other side. It is not that the mob was unnerved or fired to disperse a large crowd,” the court observed.

The court pointed out that it is not reasonable that the police fired 12 shots in the air in an incident where they saw the accused and knew the number of the accused.
The incident took place on March 28, 2019, when Inspector Satwant Singh Inspector Bhupinder Kumar, Sub Inspector Satish Kumar, Head Constable Amarinder Singh, Varinder Singh, Havaldar Varinderjit Singh, Head Constable Jaskaran Singh and Raj Kumar and Harpal Singh. Checking government and private vehicles and looking for bad elements.

When they approached the gate of Randhir Singh’s two-storied house in Ballo Majra rural municipality, three people with haircuts who were standing on the second floor gallery of the house suddenly started shooting at the police team with the intention of killing them. them.

In that, he and other police officers surrounded the house by sitting in their place.

Later Sukhdeep Kumar Sharma alias Deep fired his pistol directly at the police party and then Gurpreet Singh, whose name and address were also known, fired 12 bores directly at the police party from his desi katta. . After this, the police fired in the air for their safety.

Then a third person identified as Sukhdeep Kumar, Gurpreet Singh and Raman Kumar shot at the police team and tried to escape from behind.

After that, the police team warned the accused to put down their arms and raise their hands, and the police took them into custody. The accused persons attacked the police party with intent to kill, which fulfilled the ingredients of the offense under Sections 307, 353, 186, 34 IPC and 25-54-59 of the Arms Act.

After that, Inspector Satwant Singh with the help of the police team arrested the accused Sukhdeep Kumar Sharma and recovered one pistol with 32 bore, two magazines and two cartridges. One domestic pistol of 12 bore, one live cartridge of 12 bore has been recovered from the accused Gurpreet Singh, while an iron rod has been recovered from the accused Raman Kumar, which has been taken into police custody through a separate seizure memorandum. Presence of witnesses.
