“After hearing the Advocate General appearing on behalf of the petitioners and perusing the material on record, we see no reasonable reason to interfere with the very reasoned judgment of the High Court. Accordingly, the special leave petitions stand dismissed,” the statement said. Bench said.
The high court on November 20 passed the order on a petition filed by AIADMK legal wing secretary and former MLA IS Inbadurai, advocate forum for social justice K Balu and two others, demanding a CBI probe into the Kallakurichi hooch tragedy.
The High Court bench said, “In view of the foregoing discussion, with particular reference to the official decision of the Supreme Court regarding the transfer of cases to the CBI, this Court has taken a prima facie view of this Kallakurichi Hooch tragedy case. It is one of the rare cases which warrants a fair and impartial investigation by the CBI.” .”
It directed the state police to hand over the entire case diaries at CB-CID, Villupuram to the CBI within two weeks.
The High Court had directed the CBI, Chennai to investigate all aspects of the three cases and submit a final report to the trial court as soon as possible.
The state police will extend full cooperation to the CBI for the smooth conduct of the investigation, the bench added.
The bench said that the prima facie view was that the death of 67 people in Kallakurichi could have been easily avoided if the police authorities had kept the problem under control.
