Rural Development and Panchayat Raj Minister Priyank Kharge on Wednesday expressed his concern that the work of the legislature and the executive was done by the courts in the name of ‘judicial activism’.
During the debate on maternal deaths in Ballari government hospital, Health Minister Dinesh Gundu Rao said that the company had been blacklisted for supplying substandard medicines to members of the opposition party. However, the company was able to block it from the district court, so the government accepted the drug in its hospitals.
Intervening on the occasion, Deputy Speaker Rudrappa Lamani said, ‘It is unfortunate that the court also intervenes in such matters.
Meanwhile, Kharge said to Ashok, “I am really sorry, but in the name of judicial activism, both the legislature and the executive are working in the court. When he was the Revenue Minister, many such instructions would have come.” However, Ashok questioned why the government did not challenge it in the High Court.
Mr. Kharge further said, βThey (courts) are making laws under the guise of judicial activism. How often should this intervention be?β
He said, ‘Making legislation is a constitutional right given to this House. If they (Courts) make laws themselves and start issuing orders for executive work, then why are we there?
