The CBI alleged that a private man named Manoj Joglekar was arrested, who informed them that he had deposited Rs 60 lakh as bribe, available for distribution among officials.
On December 18, six of the arrested accused, including two IRS officials, were produced before the court. The court ordered to release them saying that the arrest was not legal as they were detained for more than 24 hours.
Nair, the seventh accused, was produced before the court on Thursday. The CBI told the court that Joglekar was supposed to pay Rs 2 lakh to Nair out of the money collected as bribe and incriminating material was recovered during a search of his house. The CBI has also claimed that Rs 47 lakh was recovered from him and the source of the money is yet to be revealed. The agency sought seven days’ custody of Nair.
Nair’s lawyers Rahul Aggarwal and Kunal Ambulkar argued that he was arrested when six others were produced before the court. They said that because Nair was not arrested in the same way that he was caught red-handed in the corruption case, the agency should have informed him and taken action before arresting him. of the Corruption Act.
The lawyers also said that while the CBI had pulled out on Wednesday for not providing the grounds for the arrest of the previous accused, they had corrected their mistake and forced Nair to sign the handwritten pages after his arrest, the process Violation.
The court on Wednesday also pulled up the agency for not keeping a case diary containing the details of the investigation in the prescribed manner and instead brought a loose sheet. On Thursday, the court again showed that the case diary was not kept as required.
Special Judge SM Menzoge said that the arrest was unfair as the case was not a trap and the CBI should have informed the accused before arresting them. Nair was released on bail after posting a personal bond.
