The Delhi High Court on Friday sought the Centre’s position on a petition by former BJP MP Subramanian Swamy seeking a court direction to the Ministry of Home Affairs (MHA) on his allegations regarding the citizenship status of Congress MP Rahul Gandhi.
The court, which was headed by Chief Justice Vibhu Bakhru and Justice Tushar Rao Gadela, sought the ‘assistance’ of the government counsel before passing any order. Government lawyer Apurva Kurup has now been appointed as senior advocate. The petition is listed for next January 13.
In November, the HC had expressed its concern that adjudicating Swamy’s petition could lead to “two parallel proceedings” on the same issue, like Bengaluru BJP activist Vignesh Shishir challenging Gandhi’s alleged dual citizenship and another petition seeking a CBI probe. The case is pending before the Allahabad High Court.
The Allahabad High Court will hear the petition on December 19 where it has directed the MHA to inform the court about the status of Shishir’s representation.
