Union Heavy Industries and Steel Minister HD Kumaraswamy and his son Nikhil Kumaraswamy have been granted relief by the Karnataka High Court regarding the FIR registered against them based on the complaint of Lokayukta SIT ADGP M Chandrasekhar.
The High Court bench passed the order on Wednesday while hearing a petition filed by Kumaraswamy seeking quashing of the FIR. ADGP Chandrasekhar has registered a complaint against Union Minister Kumaraswamy at the Sanjaynagar police station in Bengaluru.
The High Court ordered no coercive action against him and granted interim relief.
Senior advocate Hasmat Pasha, appearing for Kumaraswamy, argued that the police were trying to revive the case and cancel the 10-year-old anticipatory bail.
High Court ruled that FIR cannot be used to cancel old anticipatory bail. Additionally, the high court recorded the statement of the State Public Prosecutor (SPP) that no coercive action would be taken against Kumaraswamy in the matter.
On Tuesday, the Karnataka police registered an FIR against Kumaraswamy as directed by the court.
Senior IPS officer Chandrasekhar had alleged that Kumaraswamy defamed and threatened him and his family.
Bengaluru’s Sanjayanagar police registered an FIR against Kumaraswamy.
The FIR has been registered under Section 224 of the Indian Penal Code (BNS) 2023.
The police have made Kumaraswamy’s son Nikhil Kumaraswamy the second accused in the case.
CB Suresh Babu, leader of the JDS party in the Legislative Assembly, has been named as the third accused in the case.
The police took various cases that were not understood.
Chandrasekhar approached the court demanding registration of an FIR against Kumaraswamy.
Chandrasekhar had alleged in the court complaint that he was leading the SIT team investigating the illegal mining case in 2014 – case no. 16/2014 and after receiving more evidence in the case, the investigation team recently sought permission from the Governor to prosecute the case.
In response, HD Kumaraswamy held a press conference on September 28 and 29 – where the minister made malicious allegations, threatened the IPS officer and his family members.
The IPS officer alleged in his complaint to the court that Kumaraswamy had verbally threatened him that he would be transferred to another state cadre and also made malicious allegations against his family members.
In response to the allegations, Chandrasekhar wrote to his staff and refuted all the allegations as false and malicious.
Chandrasekhar ended his letter by quoting George Bernard Shaw’s famous lines, “Never wrestle with a pig because you’ll both get dirty, and the pig likes it.”
Kumaraswamy expressed outrage on Tuesday, a senior IPS officer, Lokayukta SIT chief, M. He termed the FIR filed against him based on Chandrasekhar’s complaint as “ridiculous and malicious”.
Responding to questions from the media, Kumaraswamy said, “During this by-election, the Congress-led state government is targeting us out of sheer enmity. I will respond to it through the judiciary.”
“I have read the contents of the FIR and the complaint. It is completely ridiculous and clearly malicious. The complainant said that I had allegedly accused her in a press conference and demanded action. Did I give false information about her? If she wants, my press Review the conference video,” the Union minister said.
