A collegium of top five judges headed by CJI Khanna met Justice Yadav on Tuesday following his remarks targeting Muslims at a Vishwa Hindu Parishad event on December 8 and the opposition demanded his impeachment.
A full court meeting was held to discuss the issue of appointing senior advocates to retired high court judges. However, it is said that the Chief Justice has raised the case of Judge Yadav.
“It is very much an ongoing case and no decision has been taken. The full court was only told to meet,” the source said.
Another source said that in Tuesday’s meeting, the collegium told Justice Yadav that a public apology on record was necessary to put the case to rest. But he wanted to make it clear in future public forums that his comments were not taken in the proper spirit.
It is understood that the collegium will wait a few days before discussing the next steps. The CJI discussing the matter with the full court is seen by those in judicial circles as an indication of the collegium’s seriousness in the matter and its efforts to “take the court into confidence” in the next steps.
Options before the collegium range from transferring the judge to initiating an internal investigation. The internal investigation process under the Judges Investigation Act is a precursor to recommending the removal of a judge to the President.
Speaking at an event organized by the VHP’s legal cell on December 8 at the Allahabad High Court premises, Justice Yadav targeted Muslims and framed the Uniform Civil Code as a Hindu vs Muslim debate where the former had improved. no
“There is a misconception that if the law (UCC) is introduced, it will be against your Shariah, your Islam and your Quran,” Justice Yadav said. “But I would like to say one more thing… whether it is your personal law, our Hindu law, your Koran or it is our Gita, as I said we have addressed evil (buraiyan) in our practice… kamiyan thi, dundrat kar. lie hain (weakness is addressed)… untouchability… sati, jauhar… female feticide… we have addressed all those issues… then why not remove this law… that while your first wife is there… you can have three wives… without her consent … That is not acceptable.”
Justice Yadav said that there is a seed of tolerance in Hinduism which is not present in Islam. He also said, “I have no hesitation in saying that this is Hindustan … and the country runs according to the majority living in Hindustan.”
