Sonu Bhati was 19 years old when he successfully cleared the written and physical examination for the post of constable in Delhi Police in 2018. However, he could not get the position. the reason? Delhi Police rejected his appointment citing failure to disclose two criminal cases registered against him.
Fast forward six years and Bhati was relieved by Delhi’s Central Administrative Tribunal (CAT), which on December 4 directed the police to consider his appointment within two months.
“… direct the respondent (Delhi Police) to consider the appointment of the applicant (Bhati) to the post of Havaldar (Executive) Male within two months from the date of receipt of a certified copy of this order,” Cat Bench. It is mentioned in order.
The bench said that Bhati will get all the imaginary benefits like fixation of salary and allowances and security. “However, he will not be entitled to any payment of wages under the ‘no work no pay’ principle,” it said.
On behalf of advocate Namit Saxena, Bhati argued that he was unaware of the case against him while filling the verification form for the post of police constable. “This Tribunal has observed that when the applicant filled his verification form on 08.03.2018, he was not aware that FIR(s) had been filed against him,” the CAT noted.
The Delhi Police argued that Bhati hid information about his involvement in two incidents. Rejecting his candidature, the police issued a show cause notice to him. CAT, however, noted that the FIRs against Bhati were “technical and trivial” in nature. It also noted that the FIRs had been quashed and that he was now “innocent and blameless”.
The FIRs were registered in 2016. While one was registered under Sections 323 (punishment for causing voluntary hurt) and 506 (criminal intimidation) of the IPC, the other was registered under Section 110 (protection for good behavior from habitual offenders) of the CrPC. .
Saxena told The Indian Express that the first FIR was registered based on a complaint filed by Bhati’s neighbors. A magistrate court in Gautam Budh Nagar acquitted him on September 5, 2018. The second case was dismissed on July 14, 2018.
