Telangana High Court Judge B Vijayasena Reddy filed a writ petition against the refusal to allow the Bajrang Dal Shaurya Yatra to be held on December 25. Justice Palle was hearing a writ petition filed by Prabhu Kumar Goud. The petitioner alleged that the refusal of permission by the Superintendent of Police, Sangareddy, was arbitrary and unconstitutional.
It was the petitioner’s case that the Bajrang Dal had planned the trip well and had taken prior permission from the authorities. The petitioner pointed out that no other religious processions were scheduled for this day. Despite this, the respondents objected to the proximity of the trip to a church that held a Christmas program in the presence of the Chief Minister.
The petitioner argued that it was not possible to fix the date of the rally as the participation of the Bajrang Dal president, who had traveled from Delhi and was busy with other activities the next day, was confirmed. He argued that the trip would not interfere with Christmas celebrations as both could coexist peacefully in a secular nation.
The applicant expressed a willingness to modify the itinerary to address any concerns. The judge then noted that secularism aims to celebrate festivals for all persons irrespective of their religion and allowed the petitioner to proceed with the journey subject to the change of route. The judge accordingly directed the petitioner to change the route and location of the journey to avoid any disturbance near the church.
