The Delhi High Court transferred the MCOCA case involving an AAP MLA from Dwarka to the Rouse Avenue court

New Delhi: The Delhi High Court on Thursday transferred the Dwarka court to the Rouse Avenue court. Judge Manoj Kumar Ohri gave this order while insisting that there is no objection if the case is transferred on behalf of the lawyer of the two accused.

The court was dealing with a Delhi Police plea seeking transfer of the Delhi Police case from the trial court at Dwarka to the special MP/MLA court at Rouse Avenue.

According to the police, the petitions for the remand of the co-accused Balyan were being heard at the Rouse Avenue District Court at the Special MP/Legislative Court, while similar petitions related to others were being registered at the designated Makkah court. Dwarka.

The public prosecutor said that action cannot be taken in two different courts regarding the same FIR and submitted to the MP/legislator that all the accused should be prosecuted by a special court.

Dismissing the petition, the High Court said, “Since the earlier proceedings of MLA Naresh Balyan are said to be in the Special Court, Rouse Avenue Court, the case (in Dwarka Court) is transferred to the Rouse Avenue Court and any further proceedings. will be distributed by the concerned Principal and District Judge.”

According to the instructions of the court, the accused Rohit and Sachin Chikara were produced in the High Court through video conference from the jail.

The lawyer appearing for the other accused Hrithik also said that he has no objection if the case is sent to a special court.

Delhi Police arrested Balayan in an MCOCA case for alleged organized crime on December 4, the day he was granted bail by a court in an alleged extortion case.

The Special MP/MLA Court had earlier denied further remand of the Uttam Nagar MLA to the police and sent him to judicial custody till January 9, 2025.
