An FIR was registered against the five on September 27 under BNS Section 103(1) (murder) based on a complaint by the victim’s father.

SHO Sharma told The Indian Express that all five are still in judicial custody on charges of tampering with evidence. Charges under BNS Sections 238(1) (disappearance of evidence) and 239 (willful failure to inform of offense by person bound to inform) were added to the FIR. He added that they found the victim in the hostel room, after which they rushed him to a nearby hospital but he was declared brought dead.

“They wanted to protect the reputation of the school and did not inform the police about the child’s death,” the SHO said.

The director had initially told the police that the child was unwell and was first taken to a hospital in Sadabad and then to Agra, where doctors declared him brought dead.

He claimed that he had brought the boy back to Hathras due to which the body was in his car.
