The Supreme Court has given various instructions to stop the illegal construction saying that unauthorized construction cannot be legalized only because of administrative delay, lapse of time or monetary investment.
A bench of Justices JB Pardiwala and R Mahadevan said, “We are of the view that there has been a violation or deviation from the building plan approved by the local body and the construction work has been carried out in an audacious manner without any building plan.” Acceptance, cannot be encouraged. Each and every construction should be followed conscientiously and follow the rules strictly.
“Delay in issuing directions to correct illegality, administrative failure, regulatory inefficiency, negligence and delay of concerned authorities in discharging their obligation(s) under the Act cannot be used as a shield for taking action against illegal/unauthorized construction,” it said.
