The Allahabad High Court on Monday (December 16, 2024) granted anticipatory bail to Nikita Singhania’s uncle Sushil Singhania in the suicide case of Artificial Intelligence Engineer Atul Subhash.
The order was passed by Justice Ashutosh Srivastava, who was hearing the anticipatory bail filed by Atul’s wife Nikita Singhania and father-in-law.
Nikita Singhania was arrested from Gurugram, Haryana, while her mother Nisha Singhania and brother Anurag Singhania were arrested from Prayagraj, Uttar Pradesh for abetting Subhash’s suicide. A Bengaluru police official said.
They were arrested on Saturday (December 14, 2024) morning and brought to Bengaluru and sent to 14-day judicial custody after being produced before a local court, he said.
In the Allahabad High Court, senior advocate Manish Tiwari initially submitted that the deceased’s wife, mother-in-law and father-in-law have already been arrested by the Bengaluru city police and the present anticipatory bail application. Petitioner Sushil Singhania alone is pressed.
It is argued that the arrest was made on the basis of a suicide note and a video that went viral on the Internet. Sushil Singhania is facing a media trial at the highest level.
It was also submitted that Sushil Singhania is an old man of 69 years and has a chronic medical condition. He is almost incapacitated and there is no question of him abetting suicide, it is further submitted.
It was also argued that there is a difference between molestation and molestation and if a suicide note is taken on the face, the deceased will be framed in a false case and accused of extorting a large amount of money, the highest level of harassment.
However, it was argued that the offense under Section 108, 3(5) of the BNS cannot be called suicide.
It is also contended that Sushil Singhania has been granted security for a reasonable period of time so that he is in a position to present his version before the Court and concerned authorities and avail himself of the remedies available to him under law in the State Court. After hearing the lawyers for the parties, the court said, “In view of the above, the court is of the opinion that petitioner Sushil Singhania is entitled to the privilege of pre-arrest (transit) prejudice.” “Accordingly, it is directed that in case the petitioner is arrested in connection with Case Crime No. 0682 of 2024 under Section 108, 3(5) of BNS, Police Station Marathahalli, Bangalore City, he shall be released. Pending submission of police report in the above case Bail, if under Section 173 (2) Cr.P.C.50,000 each with two sureties to the satisfaction of the Magistrate/Court concerned furnishing a personal bond of Rs,” the court said.
The court has also imposed some conditions such as the petitioner making himself available to police officers for questioning if necessary.
